1. Agreement & Eligibility

These Terms of Service (“Terms”) govern your access to and use of the websites, apps, and fabrication services provided by [Company Legal Name] (“3DPLS,” “we,” “us,” “our”). By using our services, you agree to these Terms and our Privacy Policy.

  • You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract.

2. Orders, Quotes & Production

  • Quotes. Quotes are estimates based on the files and specs provided and are valid for the period stated. We may adjust pricing if files/specs change.
  • File Review. We may perform basic checks (manifold, wall thickness, scale), but you are responsible for model integrity and printability. We may request revisions before production.
  • Approval. Production begins after payment (or written PO if approved terms) and confirmation of final files, materials, colors, and finish.
  • Substitutions. If a specified material or color is unavailable, we may propose an equivalent; changes require your approval.
  • Lead Times. Lead times are estimates and begin after approval; they may vary based on queue, complexity, or supply conditions.

3. Manufacturing Tolerances

Unless we agree otherwise in writing, standard tolerance targets are:

  • FDM/FFF: ±0.5% (min ±0.3 mm)
  • SLA/DLP: ±0.3% (min ±0.2 mm)
  • SLS/MJF: ±0.3% (min ±0.25 mm)
  • Color/finish may vary across batches. Functional parts may require post-processing, machining, or test-fit iteration.

You are responsible for specifying critical dimensions, orientation, and any support/finish constraints in writing.

4. User Content & Intellectual Property

  • You retain ownership of designs, models, and content you upload (“User Content”).
  • You grant 3DPLS a non-exclusive license to store, copy, modify (e.g., add supports, fix mesh), manufacture, and ship items solely to fulfill your order and provide customer support.
  • You represent that you have all rights necessary to upload and have the content manufactured and that your content does not infringe any third-party rights or laws.
  • We may refuse orders that appear to violate these Terms or applicable laws.

5. Prohibited Uses

  • Weapons, weapon parts, or items regulated/illegal in your jurisdiction.
  • Counterfeit goods, logos, or designs you do not own or have rights to reproduce.
  • Objects intended for unsafe, life-support, or medical use without proper certification and testing.
  • Any use that violates export controls, sanctions, or IP laws.

6. Pricing, Payment & Taxes

  • Prices are shown before taxes and shipping unless stated. You are responsible for any applicable taxes, duties, and fees.
  • We accept the payment methods displayed at checkout and may use third-party processors (e.g., Stripe, PayPal). Their terms apply.
  • Orders are custom and typically require payment in full at approval.

7. Shipping, Risk of Loss & Delivery

  • We ship to the address you provide. Risk of loss transfers on carrier pickup. Inspect packages on delivery and report damage within 3 business days.
  • Local pickup (if offered) becomes your responsibility upon pickup.

8. Cancellations, Reprints & Returns

  • Custom Work. Because items are made to order, they are not returnable.
  • Cancellation. You may cancel before production starts for a refund minus any pre-processing costs. After production starts, cancellation is not guaranteed.
  • Reprints. If we materially miss agreed specs or tolerances, notify us within 7 days with photos and measurements. We’ll evaluate and, if confirmed, reprint or credit at our discretion.
  • We are not responsible for errors from incorrect files, missing tolerances, incompatible design, or misuse after delivery.

9. Warranties & Disclaimers

THE SERVICE AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” EXCEPT AS EXPRESSLY STATED, 3DPLS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 3DPLS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE ORDER GIVING RISE TO THE CLAIM.

11. Indemnification

You agree to defend, indemnify, and hold harmless 3DPLS from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your User Content, your use of the services, or your breach of these Terms.

12. Copyright/DMCA

If you believe content infringes your copyright, send a notice to [Email] with: (a) your contact info; (b) work claimed infringed; (c) location of alleged infringement; (d) a good-faith statement; and (e) a statement under penalty of perjury that you are authorized. We may remove content and terminate repeat infringers.
